Terms of Service

By purchasing, downloading, or using AdServerX (the "Software"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Software.
1. License Grant
Subject to these Terms and payment of the applicable license fee, we grant you a non-exclusive license to install and use the Software on the number of domains specified in your purchased license tier.
2. Permitted Use
You may install and use the Software on your own servers for lawful purposes. You may modify the Software for your own use. You may not resell, sublicense, or distribute the Software or any derivative of it to third parties.
3. Restrictions
You may not:
- Use the Software on more domains than your license tier permits
- Remove or alter copyright notices or license key validation
- Redistribute or resell the Software or any modified version
- Use the Software to facilitate illegal activity
4. Updates and Support
Each license includes one year of software updates and email support from the date of purchase. After the first year, you may renew at the annual renewal price. Your installation continues to function after expiry; only access to new updates and support is affected.
5. Disclaimer of Warranties
The Software is provided "as is" without warranty of any kind. We make no warranties, express or implied, including merchantability or fitness for a particular purpose.
6. Limitation of Liability
To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Software.
7. License Transfers
You may transfer your license to a different production domain. A cooldown period applies between transfers. To request a transfer, contact us. Transfers are non-assignable to third parties; you may not sell or transfer the license itself to another individual or organization.
8. Governing Law
These Terms are governed by and construed in accordance with the laws of the jurisdiction in which we operate, without regard to conflict-of-law principles. Any disputes arising under these Terms shall be resolved in the courts of that jurisdiction.
9. Severability
If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
10. Changes to Terms
We may update these Terms from time to time. Continued use of the Software after changes constitutes acceptance. We will notify customers of material changes by email.
